The former couple was present at a hearing at the Orange County Superior Court in California, when their separation was authorized and they were given joint custody of Zoie.

Sweetin started dating Cody Herpin, a film transportation arranger, in May 2007. After just two months of dating, they walked down the aisle in Las Vegas in July 2007. They have one daughter named Zoie Laurelmae, who was born in April 2008.

In November 2008, Sweetin launched a case for legal separation from Cody Herpin. Herpin established a harsh custody battle with Jodie in December 2008, seeking exclusive custody of Zoie. He laid the blame on Sweetin for driving inebriated with their baby in the automobile.
