Doctor of Anna Nicole Smith Loses Dismissal Hearing

dr Sandeep Kapoor July 7 (THAINDIAN NEWS) The former physician of the late Playboy Playmate ‘Anna Nicole Smith’ recently lost a motion to dismiss his case which was being heard in Los Angeles, California, according to the ‘Associated Press’. The dismissal as rejected by the Superior Court Judge David Wesley in the case of Doctor Sandeep Kapoor.

The attorneys for the 42 year old Dr Kapoor were seeking for the judge to dismiss the charges of drug conspiracy dropped as well as another count of obtaining a prescription unlawfully by using a false name. Anna Nicole Smith died over three years ago from an accidental overdose, but the case concerning her death and illegally obtained drugs which she possessed is still unresolved.

Kapoor has been charged with conspiracy and other offenses in connection to the death of Smith on February 8, 2007. Forty one year old Howard K Stern who is a longtime friend of the doctor as well as an attorney, and Khritstine Eroshevich, who is a 62 year old doctor were both also named in the charges, and could serve up to five years each if convicted.

This dismissal means that the case will now go back to Superior Court under Judge Robert J Perry. His was the initial which determined that there was indeed enough evidence to take the trial to court. He stated that with the vast amounts of evidence which the prosecution held, that the three men should be held to stand trial. The next hearing in this case is set for July 20, and jury selection is set to begin on August 2.
