T-Mobile Sued For Blocking Access To Pot-Related Text

September 20, 2010 (Pen Men at Work): T-mobile has been sued by a company specializing in sending marketing text messages. It accused T-mobile of blocking access to its network all because of a message related to medical marijuana commonly known as pot.

The New York based company; Ez Texting filed the suit on Friday with the U.S. District Court for the Southern District of New York. The company’s business entails sending text messages to the prospective consumers who are then asked to send a specific text to a specific number in order to access more information about the product.

The lawsuit accuses T-mobile of cutting off the access because it did not approve of a particular client of Ez Texting. The website of the client (WeedMaps) involved connecting patients on medical Marijuana within the same geographical region. The patients can discuss and review Marijuana co-operatives, dispensaries, doctors and delivery services. The suit further accuses T-mobile to continue blockading Ez Texting although it had informed them that they have stopped providing WeedMaps with the service. However, WeedMaps cater to the public belonging to the states where the use of medical Marijuana has been made legal. This was another point made in the lawsuit. The representatives of Ez Texting claimed that they face the danger of going out of business in case their access is not resumed soon.

The president of Public Knowledge, a public interest group, Gigi Sohn said that this was yet another example of an arbitrary decision by a carrier to block access. He added that the FCC needs to put this issue to rest by giving the appropriate ruling.

T-mobile did not respond to the request for comment on this issue.
