Florida to receive $2.9 million from a settlement with ModernAd Media

TALLAHASSEE, FLORIDA (BNO NEWS) – Florida will receive $2.9 million from a settlement with ModernAd Media LLC, an internet advertising company which violated the federal anti-spam act, Attorney General Bill McCollum announced on Tuesday.

The settlement resolves allegations that ModernAd Media violated the federal CAN-SPAM Act, which prohibits deceptive and misleading header information in commercial emails. The span violation was revealed the Attorney General’s CyberFraud Section of the Economic Crimes Division launched an investigation.

ModernAd Media solicited consumers through e-mails, internet pop-up windows, or paid advertisements linked to Google and other search engines. Many of the advertisement s conveyed that consumers were entitled to free merchandise. However the promotional merchandise was not really free and the terms and conditions for receiving the items were misleading and confusing for the consumers.

As a result, ModernAd Media must disclose and prominently display in the future all necessary information so consumers can make decisions before they agree to purchase items or participate in trial offers. ModernAd Media will also pay $2.9 million which will reimburse the state’s fees and costs, as well as improving and continuing the CyberFraud investigations.
