Apex court rejects Morani’s interim bail plea (Lead)

New Delhi, Aug 1 (IANS) The Supreme Court Monday rejected the interim bail plea of Cineyug Films founder Karim Morani, who is in jail for the past two months for his alleged involvement in the 2G spectrum scam.

Morani had sought the interim bail to undergo treatment.

The apex court bench of Justice G.S. Singhvi and Justice H.L. Dattu asked Morani to approach the jail authorities for his treatment and the enforcement of the Delhi High Court direction in this respect.

The Central Bureau of Investigation named Morani as a co-conspirator in a charge sheet after it traced to him an illegal money trail of Rs.214 crore in the scam.

The apex court bench while declining Morani’s plea told his counsel Siddharth Luthra that merely because a person was an accused, no court would say that he cannot be given treatment.

The court said that after approaching the jail authorities for his treatment if he felt aggrieved, he could move an appropriate judicial forum.

Luthra told the court that Morani suffered from an aliment that resulted in his going blank and his pulse rate becoming uncertain. The senior counsel said that this happened under stress and physical exhaustion in custody.

The judges said that “we don’t want it (suffering) should happen to anyone but anything can happen to anyone any time”.

The court said that the high court order was quite explicit as it said that if the desired treatment was not available at the government’s G.B. Pant Hospital then the petitioner could approach which ever hospital where it was available.
