Apex court refuses to take up bar association’s plea
May 4th, 2010 - 10:14 pm ICT by IANSNew Delhi, May 4 (IANS) The apex court has declined to entertain a petition of the Supreme Court Bar Association (SCBA) which has challenged its suspension by the registrar of the co-operative societies.
However, the bench of Chief Justice K.G. Balakrishnan, Justice Deepak Verma and Justice B.S. Chauhan Monday stayed the operation of the registrar’s suspension order for one week so that the SCBA could move the high court.
After hearing the matter, Chief Justice K.G. Balakrishnan said the bar association should have first approached the high court before moving the apex court.
The association came under the scanner of the registrar of cooperative societies for putting in place an ad-hoc committee for running its affairs in the wake of a dispute among its members and for not submitting its accounts for scrutiny.
Mentioning the matter on behalf of the SCBA, senior counsel Harish Salve said the registrar’s order was violative of Article 19 of the constitution dealing with the fundamental right of free speech and expression and to form association.
He said that the registrar’s order interfered with “our right to govern ourselves”.
Salve said the registrar could not extend his jurisdiction by suspending the SCBA’s registration which was registered under the Societies Registration Act, 1860.
