2G: CBI allowed to present more documents in court
January 17th, 2012 - 8:25 pm ICT by IANS ( Leave a comment )New Delhi, Jan 17 (IANS) A special court here Tuesday allowed the Central Bureau of Investigation (CBI) to present additional documents related to the 2G case.
Special Judge O.P. Saini allowed the probe agency to place before it documents which could not be brought on record earlier along with the charge sheet.
Judge Saini said: “In view of the facts and circumstances of the case and the law applicable on the subject, the prayer is allowed and documents are allowed to be placed on record.”
The judge added: “I may mention that during arguments, it was pointed out by some defence counsel that the entire file in which documents mentioned in the application are contained may be allowed to be placed on record, to which special public prosecutor has no objection.”
The court’s order came after special public prosecutor said that there was no legal bar in placing the file on record.
The accused earlier opposed the presentation of additional documents during the deposition of prosecution witness and former Telecom Regulatory Authority of India (TRAI) chairman Nripendra Misra Jan 11.
Defence counsel said that some of the documents, mentioned in Misra’s testimony to the CBI, had not been made available.
They said that there existed no grounds to allow the application of the prosecution for filing documents, which were not a part of the judicial record.
According to the government auditor, the 2G scam pertained to a biased distribution of mobile phone airwaves and operating licences, in lieu of kickbacks, to telecom firms that could have cost the treasury up to Rs.1.76 lakh crore in lost revenue.
Nineteen individuals and six companies are accused in the case.
