2G: Behura’s bail plea dismissed (Lead)
December 16th, 2011 - 5:14 pm ICT by IANSNew Delhi, Dec 16 (IANS) The Delhi High Court Friday dismissed the bail application of former telecom secretary Siddhartha Behura, one of the 14 accused in the 2G spectrum allocation scam.
Justice V.K. Shali, pronouncing the order, said: “The bail application is dismissed.”
Behura was arrested along with former communications minister A. Raja and his former private secretary R.K. Chandolia Feb 2 in the 2G scam case. He has been charged with criminal conspiracy, cheating and forgery.
The former telecom secretary, while seeking bail, told the court that he should be released on the ground of parity with the 12 co-accused who have already been granted bail.
Behura and Raja are the only two accused left behind bars out of the 14 arrested by the Central Bureau of Investigation (CBI) in the 2G scam case.
Aman Lekhi, counsel for Behura, earlier told Justice Shali that the alleged beneficiaries of the scam are out on bail. “The bribe givers and takers are also out on bail.”
“I also deserve to be released on the ground of principle of parity and parity alone,” said Behura.
Lekhi also alleged before the court that the CBI was illegally treating the accused differently on the ground of their being private sector employees or public servants.
He said even the charge of criminal breach of trust was applicable to all accused and it was not limited to public servants.
Lekhi also contended that unlike other politically connected accused, the retired public servant lacked political muscle and financial clout to tamper with evidence.
