2G: Apex court notice to CBI on Behura’s bail (Lead)

New Delhi, Jan 2 (IANS) The Supreme Court Monday issued notice to the Central Bureau of Investigation (CBI) on a bail plea by former telecom secretary Siddharth Behura, accused in the multi-crore rupee 2G spectrum scam.

An apex court bench of Justice G.S. Singhvi and Justice S.J. Mukhopadhyay while issuing the notice declined the plea for immediate relief without hearing the probe agency.

Behura, along with former communications minister A. Raja and the ex-minister’s former aide R.K. Chandolia, were arrested Feb 2, 2011.

The apex court extended its interim stay on a Delhi High Court order suspending the grant of bail Chandolia by the special CBI court hearing the 2G case.

The apex court had Dec 7, 2011 stayed the high court order.

Chandolia was granted bail by the special CBI court Dec 1, 2011. The high court took suo motu notice of newspaper reports of the bail granted to Chandolia and stayed it on Dec 2, 2011.

The high court Dec 16, 2011 dismissed the bail plea by Behura. While denying bail to Behura, the high Court observed that in view of the “severity of accusation and the prima facie evidence gathered by the prosecution and the quantum of sentence which it carries, the petitioner does not deserve the grant of bail”.

The high court while rejecting Behura’s plea seeking treatment on par with other five accused, DMK MP Kanimozhi, who were granted bail.

The apex court directed the listing of both the matters in February.
